PHMayor Whitfield reopened the Public Hearing for Consideration/Discussion/Action on the Request by Pogue Engineering & Development Company, Inc., on Behalf of SB Harbor Market Joint Venture, for Approval of a Request to Rezone 44.46 Acres, From “PD” – Planned Development District to “PD” – Planned Development District in Order to Modify the Development Standards, Located at the Southeast Corner of Virginia Parkway and Stonebridge Drive, and Accompanying Ordinance. Assistant Director of Planning Melissa Henderson stated that this item was tabled from the August 15th meeting in order to allow staff to work on the wording for the special development and on compromises with the developer. Ms. Henderson stated that many people have been working diligently on this and a compromise is still being worked out. Ms. Henderson stated that the major points are: No horses or carriages will be allowed, City Council has discretionary approval for height, height standard is 35 feet anything above that would require City Council approval, Outdoor runs with the veterinary office will require a specific use permit and City Council action, a specific use permit for the boat in the harbor that will include maintenance use of lake and what type of establishments are allowed, and the Director of Planning can approve generalized development plans if they comply with the intent and spirit of the generalized elevations, if not they are sent to the City Council for approval. Mayor Pro-Tem Loughmiller stated that he has met with the developer and Brian James about the concerns that were raised at the last council meeting regarding the boat, dog run and specific use permits. Mr. Loughmiller stated that his issue has been that the City Council should remain the final gatekeeper on this project. Applicant, Mr. Jeff Blackard, 401 Adriatica, McKinney, thanked the homeowners of Stonebridge for all their support on this project. Mayor Whitfield called for public comment. Mayor Pro-Tem Loughmiller thanked the efforts of the people in his district. Mr. Loughmiller wished that we have continued communication between developers and residents throughout McKinney. Council unanimously approved the motion by Mayor Pro-Tem Loughmiller, seconded by Council member Garza, to close the public hearing and approve the Ordinance rezoning 44.46 acres, from “PD” – Planned Development District to “PD” – Planned Development District in order to modify the Development Standards, located at the southeast corner of Virginia Parkway and Stonebridge Drive with the following special ordinance provisions: With the following special ordinance provisions: Tracts 1-8 (shown on Exhibit B) shall develop in accordance with PD 2005-02-017 and Tract 9 (shown on Exhibit B) shall develop in accordance with PD 2005-06-065, with the following exceptions: R-2 and Town Center District – The applicant shall submit generalized building elevations with general development plan and site plan approval. Final building elevations shall be submitted at the time of building permit application. The Director of Planning shall review the elevations for conformance with the generalized elevations, the PD standards and the buildings already constructed within the project. If the Director of Planning finds that the elevations are in conformance then the elevations shall be approved once conformance with the architectural standards ordinance has been determined. If they are found to not be in conformance then the elevations shall be sent to City Council for review; The City Council may approve reductions to the required building setbacks and landscape buffer, and increase the maximum height for architectural enhancements only (cupolas, domes, spires, etc) as part of site plan approval; allow the use of a veterinarian office with an outdoor run on Lot 1R, Block B (Tract B) (Exhibit D) with approval of a Specific Use Permit concurrently with site plan approval; Town Center District - increase the maximum height for the Bell Tower to 128’ on Tract E (Exhibit F); Harbor District - Eliminate the requirement for a 10’ landscape buffer along the southwest side of the parking garage in Tract 8 (Exhibit C); provide 24” x 24” irrigated landscape planters to screen the southwestern face of the parking garage sufficient enough to provide a vegetative screening effect, in accordance with building elevation A-0 (Exhibit F); increase the maximum building height to 56’ for Building #1 (the hotel) in Tract F (Exhibit C); increase the maximum building height to 68’ for Building #3 and Building #9 in Tract F (Exhibit C); decrease the sidewalk width at the northwest corner from 8’ to 5’ at the intersection of Mediterranean Drive, Dalmatia Drive and the access drive for the parking garage in Tract F (Exhibit C); eliminate the minimum building depth requirement for Building #3 in Tract F (Exhibit C); reduce the number of loading spaces in Tract F (Exhibit C) to 2; eliminate the requirement for the screening of the loading spaces in Tract F (Exhibit C); eliminate the requirement that at least 10% of the site be in permanent landscape area and that at least 15% of the street yard be landscaped in Tract F (Exhibit C); with approval of a Specific Use Permit, concurrently with site plan approval, a boat may be allowed within Tract F, the Harbor District, not to exceed 90’ in height, in accordance with the attached harbor site plan (Exhibit C). The SUP can require provisions for maintenance of the boat, remedies to the lake associated with this development and the boat, and limit the use of the boat to establishments and restaurants that do not require a grease trap; Villa District - allow a hotel on Lot 1, Block C, of the Villa District in Adriatica in Tract 9 (Exhibit C). Mayor Whitfield called for City Council comments.
Council member Cox thanked Mayor Pro-Tem Loughmiller for all his work on Adriatica. Mr. Cox appreciated Mr. Loughmiller’s efforts along with the stakeholders and property owners in the area. “Mr. Blackard we appreciate your willingness to play along.”
